Foo Fighters drummer Ilan Rubin has found himself at the center of a serious legal dispute. New allegations have emerged over the control of a boutique drum manufacturing company.

Rubin has been hit with explosive new allegations in an ongoing legal battle over Q Drum Co., a boutique drum manufacturing company he co-owned with his late business partner Jeremy Berman.

A cross-complaint has been filed by the executor of Berman’s estate, alleging that Rubin orchestrated a scheme to wrongfully seize control of the company following his partner’s death.

“Court documents obtained by Radar show that Brandi Booth, the executor and sole beneficiary of the late Jeremy Berman’s estate, recently filed a cross-complaint in San Bernardino Superior Court accusing Rubin of orchestrating a scheme to seize control of Q Drum Co. following Berman’s death from stomach cancer in January 2023.”

The complaint outlines a wide range of specific allegations against Rubin, spanning financial misconduct to unauthorized control of company assets.

“According to the filing, Booth alleges she became the successor to Berman’s 51 percent ownership interest in the company through his estate. She claims Rubin, rather than recognizing her authority, wrongfully took control of company assets, manipulated financial records, and excluded her from the business. Among the allegations outlined in the cross-complaint, Booth accuses Rubin of selling company property without her consent or providing an accounting, taking control of Berman’s email and financial accounts, withholding company books and records, manipulating tax filings, allowing company tax obligations and SBA loans to lapse, and obtaining federal trademark registrations tied to Q Drum assets without her knowledge.”

The case is currently being heard in San Bernardino Superior Court. Further developments in the legal battle are expected as proceedings continue.

The legal controversy arrives at a pivotal moment in Rubin’s career. He has only recently stepped into one of rock music’s most high-profile drumming roles, placing him firmly in the public spotlight.

Rubin is the newest drummer for Foo Fighters, joining the band after Josh Freese was let go. Freese had served as the successor to Taylor Hawkins, the beloved longtime Foo Fighters drummer who passed away in 2022. Freese joined in 2023 but was ultimately replaced by Rubin.

Before joining Foo Fighters, Rubin served as the longest-running touring drummer for Nine Inch Nails. He held that position for 17 years beginning in 2009, after Trent Reznor personally invited him to join the band. Reznor had been blown away by Rubin’s performance at the Reading/Leeds Festival in 2007. His tenure with Nine Inch Nails earned him a reputation for precision, versatility, and the ability to perform at the highest level across a wide range of musical environments. In 2020, he was inducted into the Rock & Roll Hall of Fame as part of the band. He became the youngest inductee at the time at just 32 years old.

Rubin’s musical range extends well beyond the drum kit. He is a multi-instrumentalist and co-writer who has been a core creative partner in Angels & Airwaves alongside Tom DeLonge. He contributes not just as a drummer but as a composer and producer. He also fronts his own solo project, The New Regime, for which he writes, records, and produces every element himself. As a session musician, he has collaborated with acts including Paramore, Beck, Phantogram, and M83, and has contributed to major film scores.

With his profile now higher than ever as a member of one of rock’s biggest bands, the allegations surrounding Q Drum Co. represent a significant off-stage challenge for Rubin. The case in San Bernardino Superior Court is expected to continue developing. No public response from Rubin has been issued regarding the cross-complaint filed by Berman’s estate.
