Multiple former members of Cradle of Filth have joined a legal action against the band’s frontman. This lawsuit was reported by The PRP. The lawsuit was initially filed in Arizona on September 30th, 2025. It was most recently amended on November 20th, 2025.

The suit originally included Zoë Federoff Smerda and her husband Marek Smerda. Both had previously left the band and engaged in disputes with Dani Filth. The amended filing has now expanded to include several other former band members.

The additional plaintiffs joining the case are Paul Allender, who served as guitarist during two separate periods with the band (1992-1995 and 1999-2014); Lindsay Schoolcraft, who handled keyboards and vocals from 2013 to 2020; and Richard Shaw, who played guitar from 2014 to 2022. Sasha Baxter, also known as Sasha Massacre, appeared in two of the band’s music videos and is also listed as a plaintiff.

The expanding legal action marks a significant development in the ongoing disputes between Dani Filth and former members of the influential metal band. Blunt Magazine reported that six former members have filed the lawsuit against Cradle of Filth, its management, and Dani Filth in the United States District Court for the District of Arizona. The defendants also include Cradle of Filth LLP, Cradle of Filth Touring Ltd., and Oracle Management.

The lawsuit centers on multiple serious allegations of misconduct and financial wrongdoing. Blunt Magazine noted that the former members claim Cradle of Filth has continued to use their likenesses and recorded performances without consent or compensation after they departed the band. Their images appear on merchandise, vinyl releases, posters, online listings, and paid meet-and-greet materials. The complaint further alleges that likeness-based merchandise was licensed to outside vendors and distributed through third-party retail outlets. Merchandise featuring the plaintiffs’ likenesses continued to be sold during touring, including at physical Cradle of Filth shows, even after objections had been raised.

Beyond the unauthorized use of their likenesses, the plaintiffs have also raised additional claims. Metal Injection reported that the lawsuit includes claims for unpaid royalties owed to the former members for their live performances and contributions to musical sound recordings. The plaintiffs also allege unjust enrichment from the commercial exploitation of their likenesses and images in merchandise, sound recordings, and music videos.

The lawsuit also includes defamation allegations. Chaoszine documented that one section of the complaint alleges Dani Filth publicly claimed that Zoë Federoff drank alcohol while pregnant. He allegedly implied that a miscarriage she experienced was caused by alcohol consumption. The plaintiffs contend this statement damaged her reputation.

The plaintiffs are seeking several forms of relief. They request an order finding Cradle of Filth liable for false designation of origin. They also seek injunctive relief requiring the band to destroy and cease selling merchandise featuring their likenesses. Additionally, they are pursuing damages for unjust enrichment from commercial exploitation. No hearing date has been scheduled for the lawsuit as of yet. The case will proceed once an answer is filed and the court issues its initial scheduling order.
