Sammy Hagar has secured a legal victory in a dispute over an unauthorized Hollywood branch of his Cabo Wabo Cantina, ensuring the protection of the brand’s name and image.
A Los Angeles federal judge granted a preliminary injunction favoring the singer’s company, Red Head Inc., against franchisee Robert Azinian. This order prevents Azinian from using the ‘Cabo Wabo’ trademarks at the contested Hollywood Boulevard location.
Preliminary Injunction Granted

The judge’s decision highlights the potential irreparable harm to Hagar’s company’s reputation and loss of goodwill if Azinian continued operations under the Cabo Wabo name during the ongoing legal proceedings. Judge George H. Wu wrote:
“Red Head has shown that it has suffered, and will continue to suffer, irreparable harm in the absence of a preliminary injunction — including harm to Red Head’s reputation and loss of goodwill, both of which are not fully remediated by damages.”
The legal battle roots back to a conflict between Hagar and his former business partner over the operation of the Cabo Wabo Cantina brand, which started in 1990 in Cabo San Lucas, Mexico, and expanded to Las Vegas and Hollywood.
Azinian sued Hagar, alleging breaches of their agreement and accusing the rock star of not providing sufficient support for the Hollywood franchise, notably criticizing Hagar for not personally visiting and entertaining at the location.
Red Head’s Response And Legal Action

In retaliation, Hagar’s company filed a lawsuit accusing Azinian of infringing on the Cabo Wabo trademarks by opening a new Hollywood location without permission, thereby threatening the brand’s reputation and the quality associated with it. This move by Red Head aimed to protect the integrity and reputation of the Cabo Wabo brand.
As the court sides with Hagar, the future of the Hollywood Cabo Wabo Cantina hangs in the balance, with both parties awaiting further developments in their legal confrontation.
