NOFX frontman Fat Mike is reportedly facing legal action from longtime guitarist and multi-instrumentalist Eric Melvin over allegations of financial malfeasance. This was revealed during a roundtable discussion at the Punk Rock Museum in Las Vegas, as reported by Instagram.
Drummer Erik Sandin addressed the situation during the weekend event. He explained the circumstances surrounding Melvin’s absence from the band’s final activities.
“Eric Melvin is not here today with us because of the following reason: at 8am on Monday morning, after the final NOFX show ever, Eric Melvin’s lawyers served Fat Mike legal papers accusing him of financial malfeasance,” Sandin said. “Ten hours earlier we finished playing the final show of our 42-year career. It was the most amazing and emotional send-off ever, nothing but love, family, tears and love. That letter broke my heart, as well as the rest of the band and the crew. It still hurts today, and it hurts right now saying it.”
Despite the legal action, Sandin defended his longtime bandmate’s character.
“Melvin has made it clear, and perfectly clear, on this matter that to talk about it with him, or anybody, it must go through his counsel,” he continued. “I’ve known Mike for 43 years – I knew him for a year before NOFX: Mike is a lot of things, we all know that, he’s a complicated person, but he is not a thief. I will go on record saying he is not a thief.”
Sandin concluded by stating the band’s position on further discussion of the matter.
“We hope this gets resolved soon. But until then, here we are, and it is what it is,” he said. “And for the obvious reasons we can not, and will not, discuss any further.”
The legal dispute emerged just hours after NOFX concluded their 42-year career with their final performance.
The timing of the lawsuit adds another layer of complexity to what was meant to be a celebratory end to one of punk rock’s most enduring acts. The band’s farewell tour had been positioned as a triumphant conclusion to over four decades of music-making.
Louder Sound confirmed that NOFX played their final show on October 6, 2024, in San Pedro, California, marking the definitive end of their 42-year career. The band had announced their breakup earlier in the year. This made their farewell tour a highly anticipated series of final performances for longtime fans.
The legal action represents a civil lawsuit. Loudwire noted that financial malfeasance typically involves intentionally committing an illegal or wrongful act that causes financial harm to another party. However, the specific details and allegations contained within Melvin’s lawsuit against Fat Mike remain undisclosed to the public.
Chorus.fm verified that Eric Melvin has filed the civil suit against Fat Mike. The exact nature of the financial disputes between the longtime bandmates has not been made public. The lawsuit’s emergence immediately following their final performance has cast a shadow over what should have been a celebratory moment in punk rock history.
The legal dispute highlights the complex business relationships that can develop over decades of collaboration in successful bands. NOFX, formed in 1982, built a substantial following and business empire throughout their career. This makes financial disagreements between founding members particularly significant for all parties involved.
